OFFICIAL RULES: Please read these Official Rules of the WHMBTV40 Television giveaway contest. By participating in the Sweepstakes, you agree to accept the Official Rules and the decisions of the Sponsor (defined below), which are final and binding in all matters related to the Sweepstakes. NO PURCHASE NECESSARY TO ENTER OR WIN. THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH, FACEBOOK, INSTAGRAM OR ANY OTHER SOCIAL MEDIA PLATFORM (“SOCIAL MEDIA PLATFORM”). YOU ARE PROVIDING YOUR INFORMATION TO THE SPONSOR AND NOT TO SOCIAL MEDIA PLATFORM. QUESTIONS REGARDING THE SWEEPSTAKES SHOULD BE DIRECTED TO SPONSOR AND NOT TO SOCIAL MEDIA PLATFORM.

SPONSOR: WHMB-TV40, Indianapolis, IN (“Sponsor”)

DATES: The Sweepstakes entry period begins at approximately 8:00AM Eastern Time (“ET”) on June 28, 2024 and ends at 5:00pm ET on July 1st, 2024 (“Sweepstakes Period”).

ELIGIBILITY: The Sweepstakes is open to: (1) those in the WHMB-TV40 viewing area and (2) who are age 18 or older as of the Sweepstakes start date. Employees, directors and officers and their immediate families (spouses and siblings, parents and children and their spouses) and household members of the Sponsor, and their respective parent companies, subsidiaries and affiliates, distributors, dealerships, franchisees, and companies involved in the implementation and execution of the Sweepstakes (collectively the “Sweepstakes Entities”) are not eligible. Sweepstakes void where prohibited by law. All federal, state, and local laws and regulations apply. Limit one entry per person.

HOW TO ENTER: Attend the 2024 Indiana Black Expo Summer Celebration and scan the QR code located at the Sponsor’s booth and
then fill out the online form on Sponsors website. Alternatively, you can fill out a paper form at the 2024 Indiana Black Expo Summer Celebration and place it in the entry box located at the Sponsor’s booth or respond to a social media post about the contest and fill out the linked online form on the sponsor’s website. Entrants who complete the information form on the sponsor’s website or fill out a paper form at Indiana Black Expo Summer Celebration will be entered in a random drawing for a chance to win a prize, as described further below. Any entry method above will constitute one (1) entry.

PRIZE: One 4K 55” Smart TV ARV: $400. Winner will be randomly selected from all eligible correct entries received. The prize will be awarded. No substitution or transfer of any prize or election of cash in lieu of the prize by winner will be permitted. Sponsor reserves the right to substitute any prize of equal or greater value. Prizes are nontransferable. All federal, state, and/or local taxes are the sole responsibility of winner.

At the end of the Entry Period, Sponsor will select, via a random drawing, winners from all eligible entries received during the Entry Period. Odds of winning depend on the total number of eligible entries received during the Entry Period. Potential winners will be notified by email, telephone, and/or text message by July 5th, 2024. Sponsor is not responsible for and shall not be liable for late, lost, misdirected, or unsuccessful efforts to deliver the notification to selected winners. Winners may be required to sign and complete a General Release of Liability and Publicity Release and return it within two (2) days of the date of the selected winners’ receipt of prize award notification. If a selected winner cannot be contacted within two (2) days of notification, is ineligible, fails to claim the prize or return any required documentation within the time specified, the prize may be forfeited and awarded to an alternate entrant who will be randomly selected from the remaining eligible correct entries. If selected winner has moved to a different address, it is the sole responsibility of the selected winner to notify the Sponsor or designated agent of the selected winner’s new address. Winner must pick up prize in person at Sponsor’s location, WHMB-TV40 10511 Greenfield Ave. Noblesville, IN 46062. By accepting and/or using prize, winner gives Sponsor the rights to use winner’s name, voice, and/or likeness for the purpose of inclusion on a winner’s list, and in
advertising, trade, or promotion, without further compensation worldwide in perpetuity and in any form of media including the Internet, unless prohibited by law.

GENERAL CONDITIONS: By participating in the Sweepstakes, Entrants agree to be bound by these Official Rules and the decisions of Sponsor, which shall be final. Sponsor, Sweepstakes Entities, agents and representatives of Sponsor, its parent company, members, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) telephone, electronic, hardware or software program, network, Internet, or computer malfunctions, failures, or difficulties of any kind; (ii) failed, incomplete, garbled, or delayed computer transmissions; (iii) any condition caused by events beyond the control of the Sponsor that may cause the Sweepstakes to be disrupted or corrupted; (iv) any injuries, losses, or damages of any kind arising in connection with or as a result of any prize, or acceptance, possession, or use of any prize, or from participation in the Sweepstakes; or (v) any printing or typographical errors in any materials associated with the Sweepstakes. Sponsor reserves the right, in its sole discretion, to suspend or cancel the Sweepstakes at any time if a computer virus, bug, tampering, unauthorized intervention, or other technical problem of any sort corrupts the administration, security, or proper play of the Sweepstakes. Sponsor reserves the right to cancel the Sweepstakes or change any element thereof, with or without notice, at any time, due to printing errors, web site errors, transmission errors or other mistakes or problems in the production or administration of the Sweepstakes. Sponsor also reserves the right to disqualify, in its sole discretion, any person tampering with the entry process, the operation of the website, or who is otherwise in violation of the rules. By participating, Entrants agree that all disputes will be resolved in the appropriate courts in the state of Indiana, exclusively, and subject to the laws of the state of Indiana. By participating in the Sweepstakes, each Entrant agrees to release and hold Sponsor, Sweepstakes Entities, Social Media Platforms and their employees, officers, directors, agents, representatives, parents, members, affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Sweepstakes or resulting from acceptance, possession, or use of any prize, including without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Entries become the exclusive property of the Sponsor and will not be returned.

ENTRANTS’ PERSONAL INFORMATION: Information collected from Entrants is subject to Sponsor’s Privacy Policy below. By entering this Sweepstakes, you agree to the use of your personal information as described in the above Privacy Policy.

We do not sell, rent, or lease our subscription lists to third parties, and we will not provide your personal information to any third party individual, government agency, research firm, or company at any time. We will use your e-mail address solely to provide timely information, updates, schedule changes, or any other business-related announcements/communications regarding WHMB-TV40. WHMB-TV40 will maintain the information you send via email in accordance with applicable federal law.
